Terms of Service

These Terms of Service ("Terms") govern access to and use of the GhostAtlas IP proxy service ("Service"), operated by PLANCKMX ("we," "us," "our"), a digital agency based in Nairobi, Kenya. By creating an account, purchasing a plan, or otherwise using the Service, you ("you," "Client") agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. The Service

GhostAtlas IP provides access to proxy infrastructure — including rotating residential, static datacenter, static ISP, and static mobile proxy products — sourced through third-party upstream providers and made available to Clients on a subscription basis via our dashboard at dashboard.ghostatlasip.com.

We act as a reseller of proxy network access. We do not own the underlying IP infrastructure; it is provisioned through upstream network partners, and availability is subject to those partners' operational status.

2. Accounts

  • You must provide accurate registration information and keep your account credentials confidential.
  • You are responsible for all activity that occurs through your account, including activity conducted by anyone you share credentials with.
  • We reserve the right to suspend or terminate accounts that violate these Terms or our Acceptable Use Policy.

3. Billing and Payment

  • Fees are billed on the cycle selected at purchase (currently monthly) via our billing system.
  • Payments are processed through Flutterwave. We do not store your full payment card details.
  • Prices are listed in USD unless otherwise stated and are subject to change with notice for future billing cycles.
  • Non-payment may result in service suspension. We do not offer refunds for partial billing periods except as required by applicable law or at our sole discretion.
  • All sales are for service access, not for a physical or transferable good; proxies allocated to a cancelled or terminated account are not eligible for refund of the current billing period.

4. Provisioning

Depending on the product, proxy access may be provisioned automatically or manually following payment confirmation. We aim to provision manually-fulfilled orders promptly but do not guarantee a specific provisioning time. If we are unable to fulfill an order (e.g., due to upstream unavailability), we will issue a refund or credit for that order.

5. Acceptable Use

Use of the Service is governed by our Acceptable Use Policy, which is incorporated into these Terms by reference. Violation of the Acceptable Use Policy is grounds for immediate suspension or termination without refund.

6. Service Availability

We target high uptime but do not guarantee uninterrupted or error-free service. Proxy performance (latency, IP pool composition, geographic availability) depends in part on upstream providers and is subject to change. We are not liable for losses arising from service interruptions, IP blacklisting by third-party destination services, or changes in upstream proxy availability.

7. Intellectual Property

The GhostAtlas IP name, branding, dashboard software, and related materials are the property of PLANCKMX. You may not copy, resell, sublicense, or represent the Service as your own infrastructure without our written consent.

8. Limitation of Liability

To the maximum extent permitted by law, PLANCKMX shall not be liable for any indirect, incidental, special, or consequential damages arising from use of the Service, including but not limited to loss of data, loss of profits, or business interruption. Our total liability for any claim arising from these Terms is limited to the amount you paid us in the three (3) months preceding the claim.

9. Indemnification

You agree to indemnify and hold PLANCKMX harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Service in violation of these Terms, the Acceptable Use Policy, or applicable law.

10. Termination

You may cancel your account at any time through the dashboard. We may suspend or terminate access immediately, without prior notice, for violations of these Terms, non-payment, or conduct that poses risk to our infrastructure, upstream partners, or other clients.

11. Governing Law

These Terms are governed by the laws of Kenya, without regard to conflict-of-law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Kenya, unless otherwise required by applicable consumer protection law in your jurisdiction.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or dashboard notice. Continued use of the Service after changes take effect constitutes acceptance.
